Regarding gratuityDear all i have been working in company from 18/08/2006. so on 18/08/2011 my 5 years will be completed so how much gratuity amount will i recieve pls send me the calculations. my salary 12000 basic 6000rs. 2006 to 2007 my salary 13500 basic 6750rs. 2007 to 2009 my salary 15500 basic 7750rs .2009 to 2010 my salary 17000 basic 8500rs 2010 to present now. Lta payment by organisationDear all pls answer my query the lta years as defined by the govt are calender years and not financial years but in the books of accounts the salary claims etc have to be settled by financial year end. let me know if the following is the correct way to settle the lta claims by organisation. the current lta block is 2010 2013 1. in case the employee travels & claims lta with proofs till dec 2010 we process the lta as per the rules anytime before march on bills production. 2. in case the employee doesnt travel till dec 2010 then for the lta amount of 2010 we deduct tax & pay him the amount under the lta head in the month of march2011. similarly follow this pattern for year 2011. just want to know if my understanding is right or there is any other way of handling the lta payment cycle. regards Joining new company before leaving the old companyI had given resignation from my old company and it was accepted with effect from 20 dec 2010 and gone on leave. but i joined the new company on 1 dec 2010 that is my date of leaving is later than date of joining in new company. i want to know if pf transfer is possible because the above dates has to be mentioned in form 13 for transfer ? ? also is there any legal issue in this case when the date of joining in new comp is earlier than date of leaving from old cpmany ? ? Unauthorise absence from serviceThe employee has gone on sanctioned leave from 06/04/2010 till 17/04/2010 and thereafter remaining an unauthorised absence since 19/04/2010. the company had send him the notice of unauthorise leave on 25/05/2010 and further against sent on 18/06/2010 and no correspondence received from the employee upto 28/08/2010. now the employee had come and give reason for long leave that his father has met with an serious accident and asking for the salary and bonus now. any body advise wheather we needs to pay him the dues he is asking for or not? what are the legal actions associated in terms of an employer take and employee take. regards kosh
