Dear All,
One employee joined in an organisation within two days he met an accedent But he didn't got esi card then is there any benefits will provide the esi to that employee? please clarify my doubt .............siva

Is accident happened after office hours and inwhat condition was he when met with accident? if he has been covered under esi he is eligible for sick benefits., if he undergo treatment with esi dispensary.

Siva, If the employee's salary is below 15K he is supposed to be under ESIC. At the time of joining the HR deptt has to get the requisite forms filled up viz. ESIC declaration Form ( Form 1), Nomination Form for PF( Form 2), for factories act- Nomination form.
For ESIC you can now do online registration & get the Insurance No. of the employee, you can also download the Temporary card of the employee & use it to get him treated in any ESIC hospital/ dispensary.
In any case please fill up Accident form in quadruplicate & deposit it with the nearest branch office.

Dear Siva, In this case the company hav'nt recd his insurance just need to aply for insurance no, whether the proces is online or manual thereaftr he/she can get the esi benefit. If stil u hav any query just drop me a mail for any clarification. Thanks Sunil Sharma email:

If the employee jioned before 21st of that month.. he has every right to demand the medical expances.. becasuse on 21st of every month u have to submit the application form to ESI for new employees.

Dear Shiva,
Please apply for the ESI Number, since he has joined before two days no need to worry, as ESIC is giving 10 days time to apply ESIC for New joiner's. Take this issue to the ESIC manager, and the employee can take treatment, if he has previous ESIC number you can give transfer and he can avail the benefit.
Approach the ESIC office for other formalities. No need to panic.

Dear Members
ESI allows 10 days grace time to new employees for registration. Hence there will not be any problem for getting medical benefits for any employee who met with an accident/fell ill even without registering his name. It will be still advantageous if HR department get declaration form filled and gets employee's signature though the same has not been submitted to ESI Corpo.
Hope I am right on the issue.

Dear SIVA,
Mr. Sidman and Mr. PWB Kumar are right. As per ESI provisions you need to fill form immediately but same can be submitted in ESIC within 10 days. During these 10 days incase of any accident that employee is considered as registered even though his form is not submitted in ESIC. Please note ESI registration form filling and signing by all covered employees is must before joining duty.

If the accident sustained by your employee is an employment injury within the meaning of Section 2(8) of the ESI Act, 1948, irrespective of the fact whether he got the insurance number or not in view of his recent two days appointment prior to date of accident, he is definetly entitled to all benefits under the Act viz. TDB, PDB and DB to dependants in case expired and Medical benefits including super speciality treatment. Approach the Branch Office Manager immediately and submit the Accident Report along with Declaration Form in case not submitted earlier.

To my knowledge...
For the first 3 months, a employee who is going to apply for getting an ESI Card has been eligible for ESI benefits...with his TIC (Temporary in Card) which has to be given by ESI Corporn.
