Please be informed that Factory Rules fall in concurrent list, where in every state can modify the ruling of act but Central Factory act are enforeble on particular factory subject to its applicability.
I hereunder brief the procedure of Factory license renewal and Procedure of amendment of license (In Delhi Region) for your ready reference only,
Renewal of Factory license ,
The following documents are required to be submitted along with a forwarding letter for renewal of a Licence: -
Form No.2 in triplicate, duly filled up and complete in all respects.
Fees for renewal of Licence which is same as for grant of Licence and procedure for payment of fee for renewal is same as that of grant of licence. The original receipt TR6 is to be enclosed with the applications.
Original licence, for endorsement of renewal.
If an application complete in all respects alongwith the prescribed fee has been delivered in the office of the Chief Inspector of Factories, a Licence is renewed by the Dy. Chief Inspector of Factories and thereafter the same is returned to the concerned factory, alongwith a forwarding letter under Regd./SpeedPost
Factory may get the licence renewed either for one year or five years at a time. In case application for renewal has been made for five years, the renewal fee shall be five times the fee payable specified in the Schedule, appended below rule 5.
An Application for renewal of Licence complete in all respects is required to be made in advance delivered in the office of the Chief Inspector of Factories at least 30 days before the due date of expiry of the Licence, which is 31st December of the preceeding Calendar year for which the Licence has been granted/renewed/applied for renewal.
Procedure of amendment of license (In Delhi Region),
No Licensee shall change the name of a factory, or employ persons in excess of the number stated on the licence or use motive power in excess of limit of HP specified in the Licence. A Licensee, who desires to have his Licence amended shall submit an application in writing, stating the nature of amendment and reasons thereof to the Chief Inspector of Factories or to the Dy. Chief Inspector of Factories of the district, alongwith the following documents: -
Original Treasury Challan Receipt, being the prescribed fee, including balance fee if any.
Revised Form No.2. in triplicate, incorporating the proposed amendment.
Original Licence (for endorsement of amendment).
In case of increase in HP, power proof or Affidavit, giving the date on which the HP is to be enhanced is required to be given.
In case of a change of occupier, a proposal as per provisions of rule 8 of the Delhi Factories Rules, 1950, is to be made alongwith a request from previous occupier, an amendment fee of Rs.100/- and a copy of nomination of occupier by the present Partners/Directors, are required to be submitted.
For Duplicate licence besides fee of Rs.100/- an Affidavit is required to be submitted giving reasons of issuance of Duplicate Licence.
