Employees Compensation Act,2010 was long awaited step after independence and more so after 1958 when when substantial industrialisation started taking pace. Though inordinately delayed by substituting the word "employee" for "workman" the dynamic nature of labour law is recognised. The class of employees doing clerical work or their nature of work being interpretted as clerical
will now be benefitted. The Act has widened its scope.
Kudos to Satish for drawing the attention.

Dear All,
Please clarify the following doubts regrading Employee Compensation Act:
1. How is an employer supposed to ascertain whether an injury has occurred inside the plant or outside?
2. How is an employer supposed to ascertain the number of days for which compensation needs to be given?
These questions have been posed in the context of a situation where employees are trying to claim compensation by submitting fake complaints (ankle sprain, back pain, etc. which are not visible in X-Ray/ MRI but difficult to disprove)
