He is not ready to accept Bonus bill.

Dear Upendra, Bonus is a statutory liability to be met by the contractor. The Principal Employer is not legally liable for payment of bonus to the contract labour. The provisions of the Payment of Bonus Act, Section 8, 10/11 of the Act, imposes inescapable liability on the employer concerned to pay bonus to the employees concerned.

Even there are number of judicial pronouncement from various High Courts & Apex Court that there is no difference between contactual employee and employee for the payment of bonus. worker employed through contractors are also illegible to recieved bonus from respective contractors.

no govt. notification is there regarding chance of bonus limit. are are fac papers.
We had a talk to GLO - Amreli dist of gujarat for the same.
No official news with them for the same.

Dear Sirs, ( Ms/.VS Rajan Associates)
I have a doubt please clarify me on this. Now the hospitals have become a profit making and turned themselves from service orient to hospital industry.
Are the hospitals are covered under the Bonus Act? As there are many multispeciality hospitals are booming. Are the employees working in this industries are now not eligible for the payment of bonus as per the Act.
Kindly clarify.

Dear Shyam Sunder Sir,
Thanks for sending the bonus notification.
But i want to know that is there is any law which says that to paying the bonus to the contractor or the contract employee is the liability of the principle employer'
Our principle employer is agree in the agreement that they will pay the bonus at the time of Diwali with separate bill know he is saying that it is contractor responsibility not the principle employers.
Kindly Help Soon.

There seems to be a confusion as to the applicability of the Act for IT/Software companies since the salaries are higher than the upper limit fixed by the Act. Can anyone clarify whether the act is NOT APPLICABLE. (or) any provisions to be complied by IT companies under the bonus act
