An employee is rejoining our company 1 month after his resignation - appointment or rejoining letter?
An employee is rejoining our company 1 month after his resignation. can anybody advise whether we should give him a new appointment letter or issue him some kind of a rejoining letter?
Denied maternity benefits, now denying rejoining cooperation
Hi i worked with company for 1 year 10 months. i was denied maternity leave and asked to resign with a promise to provide rejoining and full cooperation at time of rejoining in terms of wfh and flexi timings. now at time of rejoining employer is not at all cooperating rather they are asking me to join another branch of office which is 35 kms away from current office. officially i don t have any written proof of denying ml. rather they have my resignation. i have all relieving documents. can i take any legal action now? it s more than 6 months after i got relieved from my services.
Gratuity on rejoining in 6.5 months
Hi i have received gratuity and then rejoined the same company. i have not completed 5 years after rejoining the company. am i eligible for the gratuity for the period i have spent after rejoining ? my employee number and pf details did not change after rejoining. for more details please read the below: a i worked in company 5 days a week for little over calendar 6 years 5 months 2368 calendar days and received the gratuity. b i worked in another company 5 days a week for little over 6 months 200 calendar days. i rejoined the earlier company a without break after relieving from the above company b. i have worked in company a 5 days a week for calendar 1 year 11 months 704 calendar days after rejoining. am i eligible for gratuity for this period ? my employee number pf number/trust etc did not change after rejoining.

Dear all request your help in drafting a reappointment policy. rejoining case lot of our exemployees are joining us back so i need to draft a policy for rejoining cases.we are planing to introduce certain terms and condition in this regard. i am considering employee s past record and also his exit process.whether he was officially relieved or not would like to know if i need to include any other details. regards veena
Service bond effect
I was working in a pvt ltd company and my net salary is rs.4600/ per month. after 1 and half year i resigned and joined another company but within two weeks i realized that my new job was not fit for me. i came back to old company for rejoining. company allowed me to rejoin with a condition that i have to sign a service bond mentioning i couldn t leave before two years and if i do so then i will be charged for rs.50000/. at the time of rejoining i did not fill any kind of form. as i was in urgent need of job so i signed the bond and received my appointment letter that s all. now after 6 months i am getting a good opportunity in ltd company with good salary. i tried to negotiate for rs.50000/ out of court but old company is not ready. company is saying it will file a case for breaking service bond or pay him rs.50000/ through court. i have heard pvt company don t go to court regarding service bond. they just threat the employee. my local lawyer is saying if company files a case then you have to fight. i am afraid and confused regarding court case. please help.
Rejoining of employee who has withdraw p.f. amount
Dear senior i have a query actually in my company there are more than 1000 workers. now issue is that every month 3040 people want to withdraw p.f. amount. and they cannot wait for the 5year or 7 year as per the p.f. regulation to withdraw partly amount. so we have to show left them 2 months to withdraw the pf. but worker is do work in company after 2 month we show the fresh joining of employee. so my question is that is there any provision to rejoining of those workers who have withdrawn p.f. bcz we have make every month 3040 new files apart from rejoining of employee and full & final also.
