Gratuity entitlement to staff on short term contract/ period
We are a nonforprofit research organization registered under societies act. we are a project based organization and hire staff on short term contract 1 month to 1 year and long term contract renewable 3 years contract. staff who are on long term contracts are provided retirement benefits like pf gratuity etc. in some of the cases the period of short term employees are is extended time to time. in some cases staff members are converted from short term contract to long term contract. my understanding is staff are entitled of gratuity irrespective they are on short term contract or long term. whether it is written in the contract offer letter or not. but i seek your expert advice and my queries are as follows: 1. will short term staff be entitled of gratuity if they continuously work for five years? although it is mentioned in the contract that staff will not get any other benefit. 2. if some staff are converted from short term contract to long term contract. will staff get gratuity from the date of short term contract or from the date of long term contract? 3. is societies not covered under esi?
Employment agreement - staff's copy?
Dear seniors we have a system of renewing all employee s contracts each year. usually i have them sign on one contract and share a xerox of it with them for staff s personal records. but some say that its not legal or a good hr practice to not share original contract copy with staff can some seniors advise me if that s the case? is against hr practices or labor laws to not give original contract to staff? i can make two original ones and share one with staff but my question is what is the correct practice to do? pls advise regards vineeta

In my hosp there r 10 temporary staff ie hired staff from agency already we have 15 permanant staff ...as and when nnecessary we hire the temp staff ...what to do wen the union is asking us to make the temporary staff permanent it is an extra financial burden for us
Contract labour as principle employer - if the limit is exceeded some time for some additional work?
Hi i am working in pharma company as managerhr &admin. we have company staff of around 200 staff. apart from that we are having contract labour. in contract as a principle employer we have got permission from if for 180 staff. if the limit is exceeded some time for some additional work. in that case is it necessary to increase the staff limit being provided by contractor from if. if so is there any violation for such additional staff. as per factory act company should have canteen facility where the staff strength is more than 250. since our company staff strength is around 200 we are not having canteen so far. the contract labour will be taken into account for the above parameter then the staff strength is more than 250. please advise 1. can we ask the contractor to increase the labour strength i.e more than 180? 2. we have to open canteen at any cost? thanks. karun

Hello everyone my name is vijay. i am working with the hospital as a hr manager. i wanted to know about leave applicability for staff members who are with us as professional contract holders. basically in my organization staff members are not on payroll but professional contract which is yearly renewable regularly. so my main question is " how many leaves can be given to staff members for a year?" " are professional contract holders are eligible for benefit?" i have been told :the contractor can avail a total of 30 paid holidays for the 12 months contract period. this leave can be availed proportionately for the completed contract period.as per law we are supposed to give only 16 pl and 8 casual holidays. also 4 national holidays and 4 festival holidays. please guide. thank you
