We were wanting to issue business cards to our contract stuff with the company's name. Ideally the card should read the employing company's name and address but since these contract staff are taking care of sales, we want to issue them cards that read our comapnys name.
We wanted to understand any legal implications of this.
Say ABC is our company. And the contractors are employed with company EFG. Can we have the business card designed as follows:
<Emp Name>
<Logo of ABC>
Mobile: <Emp mobile no>

Dear
Definitely if your Company's name is there it will carry a risk that the Contract employee can claim he is your employee.But you will have to contest it with other proof.

Thanks for your inputs, Sir.

We understand that the contract employees can misuse the cards. And also that tomorrow clients can come bk filing suits for misleading them with business cards like these.

Which is why we want to be sure, we are not missing anything critical and that we;re covering all possible legal bases.

That said, we also want to keep the company name and address on front of the card so that the sales staff are respected for being our comapny's representatives only.

Can you please advise if given all the above, the card design that I gave in my post (also given below)- if that will be OK in all respects?

On the Front:

<Contractor Name>

<Logo of company ABC>

Mobile: <Contractor mobile no>

Tel: <Company ABC's reception no>

Email: <Contractor's email address given by company ABC, eg. >

<Registered Office Address for ABC>

On the reverse of the card:

Outsourced by:

Company EFG

<Their reistered office address>

I'm not mentioning the position that the person holds (eg Sales Head/executive) on the card so that it doesnt mislead clients into believing that the person holds the said position in our comapny (ABC)

Dear Mr. Bhatnagar,
Here the main question is araised that, whether sales activities comes under the perennial nature or not..? so,, accordingly, it will decide that, whether it is acceptable under contract labour act. or not..? otherwise it is as abolution of employee under section 10.
