One day leave is eligible for every twenty working days, provided an employee is on continous service.

Further continuous service is defined as an employee should work at least 240 days out of 360 days, or in case he joined in middle of the calender year is should be 2/3 rd of days he should be present.

Employee is eligible for earned leave only subsequent year of his joining afte+ eligiblity as mentioned above.

In case an employee joins the organisation 1.1.2010 and he is continuous in service that is regualr in attendance then his total working days for the year would be 303 days ( 365days -52 sundays- 10 mandatory holidays as per festival & national holidays act)

Then he is eligible for 303/20= 15 DAYS EARNED LEAVE for subsequenty year 2011.

Paid leave availed in the year 2010 is considered as working days. Unauthorised absent days to be deducted from above mentioned leave calcuation.

I have one query for paid leave eligibility, to eligible to get paid leave, attendance of 240 days is required or 2/3 attendance if he has joined later period of the year. In this 240 days, is 52 weekly offs are part of this or we need to consider only work days + availed valid leaves + PH.
Request to reply on this.

Actually, out of 365 days an employee should physically work for 240 man days towards eligibility of earned leave....

Dear Sir,
Please Clarify -
1. Whether the paid leave availed in the previous year has to be taken into account only for the purpose of 240 days completion or to calculate the quantum of leave for present year.
2. whether an employee who is working for more than 2 years is eligible for leave if his total man-days falls less than 240 days in a previous year.
3.Whether leave encashment has to be made for an employee who has joined and worked only for 5 to 6 months and resigns.

Dear All,
It is not mentioned either in the Factories' Act or in any other Acts as regard to calculation of leave encashment. Some of the views that in case of Monthly rated employees, to arrive at daily rate, monthly rate should be divided by 30 days. Some others view that Monthly rate should be divided by 26 days. Request some one to highlight the correct and justifiable procedure.
