Employee absconding-project at stake-legal action to be take
Respected seniors and my dear colleagues i would like to seek your help regarding a serious issue in our organisation .an employee of our company is absconding since the 16th of novhe was a good performer and based on his commitment we have taken up a project.he is a senior employee and hence based on his caliber we have taken up a rather complicated project which if now we are going to handover to some junior staff then he will minimum need 1month training.due to his irresponsible behavior the company has faced monetary loss as he has also left his current project half done we have sent a show cause letter to his mail id and also sent the same letter to his permanent address .we are aware of the company where he has joined in the management is furious about this and wants to take legal action .can you please tell me what legal actions we can take on him ? the management also wants to publish his photo on the newspaper with a note that he is absconding from the company .can we do that ? please help me on this i expect your prompt replies on the same as the matter is very urgent thanks and regards indrani chakraborty
Advise on absconding employees......
Hi seniors i want your advice on employees leaving organisation with out prior notice/ without servicing a minimum notice period. please advice if any legal action can be taken on absconding employees. what is the procedure and how successful it is.
Is it legal and right for company to ask for recovery of notice period in absconding cases?
In absconding case we require your advice. employee is absconding from organisation so company hr send him first notice letter but employee do not respond to letter. after this hr sends him 2nd letter and when no respond from employee then company terminate employee marking reason as absconding and send termination letter with notice period recovery to employee. this time employee responds to letter and clear his notice period dues and ask for reliving letter. assuming there is clause in appointment letter which says if either party wants to end contract then they have to serve 1 month notice or salary in lieu. there is no issue in notice period clause now questions are following: 1 is it legal and right for company to ask for recovery of notice period in absconding cases? please provide reason. 2 in above case after clearing notice period dues is employee entitled for reliving letter? why? 3 how absconding termination is different from other terminations from notice period angle
Absconding after resignation
Dear all we re a leading company in the engineering sector based in mumbai. the issue is that one of the employees have submitted his resignation and has been absconding since then. he s not yet completed his notice period. please advice of any legal action against him. what if he has already joined another company?? can he be traced and penalised? graham
Urgent query about termination
Hi all i need advice from legar aspect.we have issued a termination letter to an emplyee yesterady to be relieved after 1 month notice period from our end.however due to some strange behaviors of person mgmnt feels that we should relieve him with immediate effect. pls advice if we relieve him tomorrow itself will it create any legal issue.we will terminate him with 1 month salary. need urgent reply.

Hi all i have resigned from an it company after working for a year followed the official process that is resigned from the company s portal resignation got accepted by hr. i had a word with hr and was asked to serve the notice period of 1 month. i clarified that i won t be able to serve the same instead requested them to not process my payment for the notice period but they didn t agree and sent an email to me informing me that they will be treating my case as absconding. i am not sure if this is absconding so kindly help me in clarifying if this is a case of absconding and if serving notice period is necessary as many of my colleagues too resigned without serving the notice period.
