Suggestion on pf & esi benefits
Dear all my question are 1. if a person joins in an organisation as a trainee and gets stipend then will he be eligible for pf & esi? 2. also if a person joins as an executive with such terms and conditions like he will be on probation for six months then can a company opt for not providing pf & esi benefits untill confirmation? as per my knowledge pf & esi is not subject to whether the person is in probation or confirmed. plz suggest. regards dg

Many organisations recruit a new employee as trainee for first 3/6 months. later the employee on successful completion of training is put on probation and later for confirmation. please inform lawful leave norms for a trainee. also whether pf and esi is applicable on a trainee staff? i understand that even a casual mason or plumber or electrician if visits the employment for repairs attracts esi contribution. request seniors to respond please.
Difference b/w permenent worker & temorary worker
Dear all member need help for above topic. we have two categorized worker one is permenenton payroll whose getting a benefits of leave pf esic and another is temporary worker whose getting only esic benefits. but problem is that permenent worker getting less cash carry againts temporary worker because pf deduction of permenent worker s salary so that they gets less cash carry rather than temporary worker. so there is big problem of permenent worker s turnover it will effect on productivity quality time consume for worker recruitment. pls help me out for how can i positively diffrenciate a permenent worker & temp.worker. i want to retain both but there is some motivation for temp.worker to be a permenant how? regards pundlik bhavsar hr executive
Trainee worker
Hi all please guide me i want to appoint a worker as trainee for the period of 11 months on stipend of rs. 3500/ thereafter i will be appointing him on probation on 3 months and later on he will be confirmed. now in this how do i go about it please explain. 1 is it legal or illlegal ? 2 during trainee period pf & p.t. should be deducted or not ? 3 if i am paying him 3500/ then am i allowed to pay as 2000/ basic and 1000/ d. a. or it should be paid as consolidated ? please revert back asap. raj

If the employer employs any person as trainee for 12 months or more in his organisation is he bound to contribute to pf or esi fund? shall the employer deduct any contribution from his trainee for pf or esi fund? joy de

Dear all is it mandatory to extend the benefits of pfesibonus and other statutory benefits to employees employed as trainee in the organisation without registration under apprentices act. if it is mandatory kindly mention the section/clause under the respective acts. regards parag
