Employee is insisting on one more month's salary by justifying that he is not leaving on his own
My employer doesn t want any further service from an employee so sent him a mail personally and asked to treat the mail as a notice period also to serve one month before his reliving the employee also served one month payment paid till his relieving date from the company. now the employee is insisting on one more month s salary by justifying that he is not leaving on his own. is it correct or not? pls advice

Hi i have 4 years of experience in dot net .i joined in new company with 6 lakhs salary almost completed 1 month but i am looking for 7.5 lakhs salary so i am not able to concentrate in my job i am totally confused. can i resign the job notice period 60 days and search new job or can i ask current organization to give my expected salary.
Relieving letter
My company is telling me that he will not issue the relieving letter because i have not served the notice period of 3 months after resignation. is it mandatory to serve the notice period? i have some problem with manager and thats why i resigned and so i have also not served the notice period. now i wanted to know that how to get the relieving letter because company is insisting on notice period.
Salary in lieu of notice period - if employer (company) objects how to overcome?
Recently due to personal reasons i have resigned my job. in my resignation letter i have mentioned that i am ready to serve the 2 months of notice period of actual 3 months as per the company policy. but management have accepted my resignation after 20 days and insisting me to serve complete 3 months notice period as they havent got suitable reliever. as my offer letter says below point: "after confirmation termination of employment by either party will be giving three months notice in writing to the other or salary in lieu thereof" in my case i was ready to serve 2 months notice period and for remanning 1 month can i buy back should i pay my basic salary or gross salary and can i releive on my 60th day of my notice period with mutual agreement. if employer company objects how to overcome. please advise.

Legal action against for not relieving early
I am working in a organisation for 8 months. my notice period is 3months i had applied for resignation by july 02. i had been insisting about buying my notice period in 45days but the organisation did not take any action against it.lots of mails conversation between hr and managers. it is around 50days still the company had not got a replacement for me. the hr always redirect to the manager and manager keeps on saying unless he get a replacement he will not relieve me. still date i did not get a resume to interview anyone for the replacement. can i take any legal action against the company for not relieveing me while iam ready to buy the notice period. i need to join an company by 18th august iam ready to buy out the notice period. most of the time i am sitting idle in the company with no work i am just being as a buffer only. there is nothing to do as knowledge transfer also. day by day iam grewing anger as for holding me for just being as buffer and sitting idle for doing nothing. in between i had idea of quiting the company just like that but my recruiting company said it is not the right thing and wants to be relieved formally with all letters from previous organisation. i want to know whether : 1.can i take any legal action against the company for not relieveing me while iam ready to buy the notice period. how long is the process going to take. 2.ls the acceptance of the resignation email confirmation from company is enough or the formal resignation letter is required.
