We are an education organisation. We have been deducting PF for all the employees from the day of joining . Now we think for the new joinees having basic salary above Rs.6500/- per month, we shall provide the option to the joinees whether they need PF Dedcutions or not. Can we do this for part of the employee.......

If the new joinees interested not to deduct PF (those who are drawing a basic salary of more than Rs 6500 ONLY), you can get a letter from them requesting not to be covered under pf as they are drawing ________salary pm. and based on that you need not deduct pf for them.BUT KEEP IT MIND THAT FOR EXISTING EMPLOYEES,THOUGH THEY ARE CROSSING 6500, PF DEDUCTION SHOULD NOT BE WITHDRAWN.

Yes, we also deduct the PF of employee one who exceed the basic limit i.e. 6500/-
This basically it depends on employer that he is deducting the PF of employees who exceeds the the PF limit or not.
On the other hand if an employee don't want to deduct his PF (Incase he is exceding the PF Limit- for New JOinees only, not for existing), He has option, not to deduct his pf, He has to fill a form 11, or has to drop an application to declear for not deducting the PF to the company's HR Dept at the time of Joining.
and for existing employees, if an employee is crossing the PF limit, It is not withdrawn, this already given by MR. P Ramachandran.

According to me, each and every employee MUST be covered under P. F. Scheme, if the organisation is already covered under it.
The only discretion you can exercise is that Employer's contribution could be restricted to the Maximum salary limit of Rs. 6500/- PM.
There is no question of giving 'Option' to the employees ( Drawing salary more than Rs. 6500/-PM), whether they want to join P. F. Scheme or NOT.

Hi,
The information mentioned below is ok but just have confusion on the lines " BUT KEEP IT MIND THAT FOR EXISTING EMPLOYEES,THOUGH THEY ARE CROSSING 6500, PF DEDUCTION SHOULD NOT BE WITHDRAWN".
It means that if a company is registered under PF scheme after the initial date, then the existing employees whose basic salary is above rs6500/- are mandatorily need to deduct PF.
I think this is not the case. If they are filling form 11 and declaring that they were not member of PF in past and at present drawign basic salary above than Rs6500/- , then they need not to be a member of PF.
