My brother has resigned from a company one and a half month`s back and joined a new company. He was not a confirmed employee of previous company and as per the terms of his appoinment letter he gave 24 hrs notice to the company. He has done all the exit formalities and his company told him that he wolud get relieving letter withen a week, however now the company is not giving releiving letter or even resignation acceptance confirmation even after repeated request/reminder. Please advise how he can take his relieving letter as his current organization has asked him to submit the same withen a week failing to which his sevices wolud be terminated.

I am sure your brother have shown all the documents exchanged with regards to release from his former employer, to his new employer . Did he keep a copy of the resignation and exit formality forms that he filled and submit at his former employer?
Now please suggest him to draft a very formal mail, quoting the clause from the appointment letter which allows him to resign and be released from his job within 24 hr, during probation. Please mention a deadline earlier than the 7 days mentioned by his new employer, as he would need to collect and submit it . Please make sure the new employer is marked a Copy in this mail. Do add all the earlier interactions as annexure and every supporting document for release.

He may find a twisted reply. But it will help him gain credibility with the new employer and may earn him some more time. Do consult a legal advisor, though refrain from taking any legal action. You just need to know. This will get resolved no sooner or later.
