6+ years in an it company in product support team - the ex-employer is not ready to pay it
I have served about 6 years in an it company in product support team in bangalore. the company is a pvt ltd. when i asked for gratuity with my employer they have said that it was not a part of salary structure in 'company'. i agree that there was nothing written in papers about gratuity. it was only big money expected since there was no pf as it was a small size company. now i have below questions. 1. am i eligible for gratuity? 2. is there any rule that the gratuity will not be considered if the company s financial status is not good? 3. is it mandatory to pay gratuity even though there is no written document available with respect to gratuity? 4. if my exemployer has to pay the gratuity then how would i proceed further to get the gratuity as the exemployer is not ready to pay it.

Dear hr professionals greetings my husband is working for a us based mnc software company located in hyderabad and will be completing 5 yrs of his service this year with them. unfortunately the company does not pay gratuity.the workforce here in indiahyderabad being the only branch in india will be between 150 to 200 employees. i am a recruitment professional and i understand that gratuity payment is mandatory for any kind of organization after fulfilling certain norms . why is that his company does not have the norm of paying gratuity?please enlighten me more about gratuity rules. thanking you purnima

Dear all i have a query regardig the paymet of gratuity. is it mandatory for a company to pay gratuity wherein an employee completed a tenure of 5 years whereas the company got registered only in 2008 and prior to that was like a partnership firm. we have two cases where the employees have joined in 2005 and have left in 2011 and the company denied to pay gratuity to them stating the above mentioned reasons. in this case is it mandatory to pay gratuity to these employees? thanks & regards neha

Dear all any one know the gratuity rule my last company did not pay my gratuity amt because i absconded and they said the reason for same the amt is nearly 1.16l and they also dedicated 1 month s notice period salary from gratuity amt letter also send full and final but not pay.

Dear all members if somebody can guide me regarding my gratuity related issue? i worked for a limited company for 9.5 years. in the appointment letter they have mentioned that you are eligible for the all co.'s benefits but not mentioned like pf & gratuity words. now when after resigning from the company i requested for the gratuity they say that they do not pay any. what are the rules? as per my knoledge even a shopkeeper has to pay the gratuity to the sales man if he has worked more than 5yrs. but i was working in a limited company where more that 500 peoples are employeed. can i file suit against the company? where i have to file the suit to get my gratuity? please help>>>>

Hi i have completed five years in a startup company recently. now i have got new opportunity from an mnc and i will be shifting this month. when i asked my manager about gratuity he said we did t had any provision for gratuity and we haven t deducted any amount on account of gratuity ultimately they are denying to pay. 78 months earlier we had business meeting where hr has given presentation about new policies and other things she has mentioned about gratuity benefits to the eligible employees. i just wanted to confirm that the company has to pay gratuity mandatorily to the employee who has completed 5yrs or it is not mandatory. please advice. thanks sachin
