Hi,
I have a friend who only finished his 12th. He used to work as office boy but got involved in a cheating case. Although he is not guilty, he got framed by some people & because of poverty, he could not fight & win the legal case. He got convicted for 2 years normal imprisonment. He completed his sentence & is now free. He is trying to find a job. But everyone who knows him are reluctant to give him a job.
I suggested him to try in a call center. Before he could get to HR round, they asked him to improve his communication skills & come back. Now he is not sure if he would ever get a job.
Is there any legal policy which prevents convicts from getting job? Would appreciate any help regarding this issue.

@Fred -Thanks for the response. Ill ask him to go for the course. Are you in europe or something? Your email id looked like that. Anyways, I dont know if he will accept any such help. He is the kind of a guy who wants to stand on his own feet by himself. I know, kinda crazy, but he is like that. But I can guide him from what info I can gather from here.
While I was joining my company, during the induction, I was asked to sign a few papers & one of them had this column of having a case against me. I didn't bother to read throughly due to obvious reasons. I dont remember the exact details though. So I thought I might as well ask the experts.
If anyone could throw some light on this matter, would appreciate it.

Hi,
In india there is no rule for the private sector as to not to employ an ex - convict.
BUt surprisingly for many government jobs the governent makes police verifications and rejects the ex- convicts.
Kindly explain what this column of having the case against you. Is it indicating that the company will initaite a case against you on a specific vilation or just asking about any cases penidng against you? Based on this would be able to give a clear answer.

@Dayanand - Thanks for the reply, but it is not about me but my friend. He is not well-versed with computers & internet. So I am trying to help him out. The case is not pending. He already served the sentence period of 2 years. But I am asking out of curiosity, if there is a pending case against a prospective employee, would companies not hire him/her on those grounds?
I have heard about the govt jobs part, where in he needs to get some NOC from local police station etc.

Hi,
Effect of a pending case on the prospective employment in private sector depends on
a) nature of cases / charges made. If the cases are of garve nature like, those involving fraud, attempt to murder, rioting, then they are clear no points for hiring.
b) In some IT and ITES companies even if there is a case pertaining to dowry harassment and cases for having employed child labour for domestic work and torture to domestic help, become clear hindrances for employment and employees on roll being separated.

Thank you for the clarity. His is related to fraud. Besides, he was only a witness. He did not even do the fraud. He got setup into the mess. Thanks for the help again.
Dear Vignan,
Corporates do a background check of his educational qualification, his previous employment, criminal background etc before they employ anyone through external agencies. This is done mostly by the corporates. Please suggest your friend to try in a small company or a consultancy which normally does not verify the background through external agencies.

@Biswal - Thanks for the insight. I was aware of that. Infact I am working for an MNC. I suggested the same thing to him. The problem is, we dont know which companies do & which doesnt do the background check. Anyways, ill check with him & let him know.
