Hi
My wife is working in a autonomous college in chennai and she is in the 9 month. Doctor advised to take rest as she was very week. She has submitted the doctor certificate and asked for maternity leave but still they want to continue until some replacement is found.

As per law she is eligible for 90 day pay with leave right? What happens if she takes more than 90 days leave. Can she take leave for 6 month to take care of the baby and rejoin the college.

If the college is covered by Maternity Benefit Act and not by Maternity Rules of the University (which University I don't know) or Sate's or Central Maternity Rules, she can take only 84 days leave (ie, 12 weeks leave) with pay. She need not wait for a reliever but is eligible to take it 6 weeks prior to expected date of delivery also.
In case she is medically not fit as certified by medical practitioner she can take one more month's leave but not more than that. Please ensure that no rule of the University/ State Govt/ Central Govt is applicable to the college where she works.

Thank you for your comments, She is working under state Government college and working there for more than 3 yrs but till now not confirmed as she is working for evening college.

If she is coming under the State service Rules you have to check whether the provisions of Maternity Benefit Act is applicable to her or not.
Depending upon the rules of the company or provisions in the certified Standing Orders of the company, an employee under the notice period can avail any kind of leave that is available to him.
