hey can any 1 tell me that thr is a foreign company setting up their branch office or liaison office here in india, so the point is that they want to continue their work on any national holiday like 26th jan or 15th aug here so can they get work permit for that and whats the procedure to obtain that work permit and to whom shall they be accountable, means to which ministry or office of govt.

Who ever is the company / individiual they have to abide by the law of the land they operate in. Can they work on the national holidays in their own country of operations?
However only certain factories and indutries considered to be having continuous processes, hospitals and travel agencies are allowed to operate on all 365 days and 24 hours subject to additional payments to the workmen / staff deployed for work on those days.
The company setting up a branch office can not be considered under the above definition and hence must observe the laws of the land.

Hi,
You may kindly refer to the National and Festival Holidays Act. Each State has its own Acts in this regard. The enforcing authority will be the State / Central Labour Department within which your company falls.

As per your query you are going to open your office in India & therefore you will be governed by the Shops & Establishment Act of the State in respect of grant of National holidays where you will open your office. Go thtrough this Act to find out the proper reply on holidays.

Foreign Company must have set up the branch office/ liaison office in India to have business in India. India is off on national holidays to have any business.

if the same query is raised and this time it is about the private limited company, will it be governed by shops & establishment act? and national & festival holidays act will also be applicable to this co.

There is nothing call local BPO or international BPO.. Any establishment which operate in the geography of India have to follow the law of the land.
There are national and State legislations which prescribe the requirements / conditions which one has to follow. The answer to your questions is already provided above.

There is no prohibition for working.Work exigencies may require continous working.If you make somebody work then you will have to pay him three times wages or two times wages with one day off.

Company is permitted to work on NATIONAL HOLIDAYS provided that its employees is paid double the wages or the a compensatory leave for the day worked.
