I would like to know is it mandatory for a Private Limited company's Head Office located in Delhi (which is not a shop) to get registered for Shops and Establishment Act. Different persons have given different views.What is the fact?

If the head office is not a shop why should there be a confusion? Alternatively, if your apprehension is about registration of the head office (in Delhi) of a factory then I will say that since the Head Office is not situated within the factory compound, it should have separate registration and since it is not carrying out any manufacturing activity therein, it should be registered as a shop under the Delhi Shops and Commercial Establishments Act. In other words, any office of a factory, mine or plantation which is situated outside the premises/ compound wall of the said factory, mine or plantation should be registered under the respective State's Shops and Commercial Establishments Act.

I repeat, if your concern is about registration of your head office in Delhi and is separate from the factories being controlled by it, it should be registered as a shop. Regards, Madhu.T.K

Dear Krishan, If you are not a shop but a commercial Establishment. You are governed by the Act. Any industrial establishment other than a factory will fall under this Act regards

Here the idea is not to go for debate, but how do I confirm, whether I am eligible for registration, can you suggest me the name of office to be approached for finding out how to apply and whom to contact, my location is in Delhi.
