Obivsouly...... As a responsible Managment, once u get a resigntion letter, you are expected to acknowledge it and should give Relieving Order.

The issue of a releiving letter must be viewed in the context of the Contract for employment.It is important that the new employer enters into a fresh contract of employement with the candidate and the only proof for the fact that he is not on contract elsewhere is the releiving letter which actually terminates the previous contract of employment.

While it is common now for employers to take on a new recruit even without a relieving letter,let me share a very clear case that happened in the banking industry a few years back.

A young man left a PSU bank to join a private bank which took him on without a relieving letter due to urgency. A few months later , they got a call from the PSU bank who informed that this guy was under suspension for a fraud and was to be dismissed. When they heard he had joined the new bank,they were very upset. Later, the private bank got pulled up by RBI officially, as they had let the man join when his original contract of employment was still valid.

A releiving letter I feel is a must, to indicate termination of contract of employment.

Hi All,
I Came out of my previous company without resigning properly where i was in a probation period of 3 months, now joined a new & better company. My new company is asking relieving letter for verification purpose.
When i contacted the old company they said it is not possible since they have closed my employement in abscond case. I left the company in Nov'11 & gone back asking relieving letter by feb'12.
Please let me know how to get the relieving letter from the company officially or legally. My intention to leave the company was not to waste time there as i was not interested in the job.

Hi,
I have received the relieving letter from the employer(India).The letter reads :
"This is to certify that that MsXXX ,whom the notice of separation has been given on 6th of dd/mm/yy,has been relieved of all her responsibilities at xxxx company,with effect from dd/mm/yy "
My question is ,whether this relieving letter will be considered as a termination letter ?If yes please explain the reason and if no,please explain the reason.On the same note would like to say that i've not received any prior notice/warning by the employer before receiving this letter.I'm not understanding how to place this letter before the employers and how they are going to treat it,since the term "notice of separation" is not clear to me at all.Please help.

The letter given by management will serve as termination letter.
The very wordings itself indicates that you were given notice of separation and after the period you have been relieved of all duties with the company.
Were you on probation or contract with the organisation?
Notice of separation has negative connotations in my mind.
Other learned forum members can comment on this aspect.
