Dear all please clarify any one my queries is as follows 1. i am working in manufactring industry. the last year asst labour officer approached us and asked me to show the drivers wages which we are paying. he said that you have to pay the driver wages under proviate motor vehicle go. i apposed his statement and replied him that the go is not applicable to us since the factory act is applicable. as par as my concery private motor transport under taking go is not applicable if the employee engaged under factories act. please clariffy 2. if we have drivers less than 5 in a manufacturing industry whether we need to register under motor transport workers act ramu 9493729677
Who is a motor transport worker by the mtw act?
Dear all i would like to know who is a motor transport worker and what is a motor transport undertaking as per the motor transport workers act 1961 with clear examples please. what i am looking for is not reproduction of the definitions available in the bare act but some live examples. for example if a bpo company has its own fleet of buses and transport staff like drivers will the company then be called as motor transport undertaking? the driver as motor transport worker? in another case if a company uses its own fleet of trucks for transportation of scraps from one of its godowns to a dumping site will then the company attract the provisions of the mtw act? the cleaner boy attached to the truck will be a motor transport worker? if someone can elucidate upon the overlapping areas between mtw act factories act and shops & establishments act and the problems faced by the organisation due to such overlappings and ambiguity it would be very interesting for enhancing our knowledge on what is happening in the country on these legislations when they compete with each other for covering the same organization. in anticipation of your valuable responses govardhan
Need clarification on motor transport workers act
Dear all is motor trasport act is applicable to all factories where in 5 or more drivers were enaged on internal transport of goods vehicles and staff transport vehicles? if so when all the employees are covered with all the labour laws and factorie act and getting all the benefits out of all statutories like other employees is it necessary to implement? if it is to be implemented for registration under this act what is the fee to be paid? who will be the stautory authority under state government? pl. clarify urgently. regards lakshmana rao
Motor vehicle act - other act's applicability - logistics companies working for us to transport semi finessed products to locations
Dear friends i am into bocw we have some logistics companies working for us to transport semi finessed products to locations they all registered under the shops and establishment act but i think they need to have registration under "the act" whether all other acts applicable to mvc: clra of min wages compensation bonus gratuity pf esi group insurance etc
New labour code and sales persons etc of establishments covered by shops and commercial establishments act- need clarification
The occupational safety health and working conditions code 2020 covers sectors like factories mines dock plantations and activities like construction beedi and cigar manufacturing cine production and conditions of service of sales personnel interstate migrant workers and employment practice of contract work. but the establishments which are not factories mines or plantations but are covered under the respective states shops and commercial establishments act will continue to be covered by that act. if that is correct i need one clarification ie 1will the sales personnel employed in such shops/ commercial establishment be covered by the occupational safety.code? 2will the contract labour and interstate migrant labour in the commercial establishments be under the said code? now the present act ie sale promotion employees condition of service act 1976 covers only sales personnel of certain industries. initially it was meant to cover sales personnel of pharma industry but later on some 10 or 11 industries were added and obviously there are a number of industries which are yet to be covered. the code has no reference as to which sector should they represent and naturally it should be understood that they will be covered irrespective of industry. that widens the scope of sales promotion employees. but is it possible that sales promotion employees of a trading organisation covered under the shops and commercial establishments act which is out of the purview of the code become part of the code? if sales promotion workers are covered the clerks and others who are working in the shops and establishments only will be left out. under the code inter state migrant labourers shall include those recruited directly by the employer but under the existing act those who are recruited and paid directly by the employer is not an interstate migrant labour. similarly there are different treatment with regard to contract labour under the code. my question is if a shop is not covered by the code is it possible to cover certain employees like sales personnel migrant workers or contract workers only under the code? if yes how can the shop/ commercial establishment obtain registration? it may also be noted that the definition of motor transport worker excludes workers working in the office of the transport company which is under the shops and commercial establishments act madhu t k
Loyal labour inspector with thoughts (how to implement the same- need senior views)
Dear member s last month labour inspector visited our plant and suggested that under payment of gratuity force the contractors to take nomination forms for the workers. he told that companies and contractors are exploiting workers as cost cutting and reduction is always done in manpower. i told him that contract is for one year and subsequently contract workers are removed from the company after one year and it dosent come under the liabiltiy of principal employer to provide teh gratuity. instead of that we can generate a gratuity fund where the amount to be deposited for the gratuity to the workers and deduction of same amount to be made from the contractors it self and at the end of contract. the amount can be distributed to teh contract workers in the presence of comapny represntative.
