Dear All,
Need an urgent guidance from you all.
I am working with 'A' company and gave my resignation to my Immediate superior on 10th Jun cc to his superior too, but dint marked the mail to HR.
Company is having a clause of Serving 2 months notice period. Now I have got struck as my boss is angru with this non-discussed resgination and creating problem and he is threatning me to serve 2 months notice period. I have given notice period till 30th Jun seeing that I have 30 accumulated leaves, which can get adjusted, moreover if something I will have to payback then I am ready for that too.
Please suggest what I need to do so that I get my resignation acceptance and F&F shettlement done.

Hi,
As per the offer letter signed and agreed by you, you need to serve 2 months notice period. It is upto the management decision to either waive the notice period or accept earned leaves or notice period pay in lieu of the shortfall.
You should discuss with your manager asking to relieve you by serving lesser number of notice period. However of the manager decides you need to serve full notice period, then cant help.

Dear Binita,
Notice period is to serve for 2 months as specified in appointment order. Waiver stands at management's descretion. And there is no issue here, as you are even ready to pay for the days of non-serving. Speak to your HR directly, So that you could get an idea on the consequences...

Speak to your HR and take decision........
But it's better next time to discuss with your management / higher-ups before you put papers, so that anger and enemity can be avoided. Remember one thing, if you dont support, you cannot expect the support............. Hope u got it...

Thanks Shree & CRK for your revert. Telling u fact my Boss would have never released me even if I have discussed with him earlier. He is a person with HUGE EGO. In last 2 month 6 of our team member has resigned due to his attitude for understanding his subordinate as SLAVES.
Pat 2 days my boss is trying to convince me very softly to stay back atleast for 6 months, which I am continuously denying, so now he is getting more aggresive and shoting like hell.
Today I discussed with HR all the things, but they are also saying that without your superior consent they can't releave me.
Suggest what needs to be done.

2ndly, pls suggest - what if I quit on the said date mentioned in resignation as I have calculated nothing is left on me nor company to take or give.
Do you guys think this can lead to some Legal issue and all???

Binita,
Just have official mail proofs of your resignition and all the communication in this concern. Shoot an email to HR and your Boss that you want to get relieved by so and so date and request for the process of relieving. All this should be through email (so that you carry proofs). If no reply, just put 3 reminders. If you get reply, respond accordingly. If you didn't get response, shoot an email saying that you would leave the company on that date.
You have to pay to the organization, if you need permanent relieving letter. Nothing for them to proceed legally after so many intimations from you. Even they proceed you will have sufficient proofs with you.
No issues.......... Take a wise decision...... If you have further queries, its advisable for you to meet a legal advisor and take decision.

To stop the issue going in the direction of legal action against you, you should read the appointment letter or contract (if applicable), secondly you should go through the HR Policy of your company.
In this case, there must be something in HR policy / company contract / appointment letter regarding your notice period and the consequences of not serving the notice period. For example- "you will have to give 2 months notice period otherwise 2 months basic will be recovered from your F&F settlement..."
So, in most of the companies, it is clearly mentioned and told in advance that what can happen if you don't serve the notice period. In your case, if it is written that you'll have to pay 2months' basic and in this case, you are ready to do so, you can easily leave the company citing the same.
So, go for it and act according to the contract/appointment letter/HR policy
