Friends!!! if Union submit the letter to recommend for protected workmen, than what action will be applicable by the Management? Please help!!

Under normal circumstances the management can approve the list given by the Union and declare the persons named in the list as protected workmen. But if any worker against whom any disciplinary action is pending is included in the list, the management can refuse to declare that person as protected workman. But it should not be exercised to victimise the worker.
