Can anyone help me with the following issue:
I am working in a Construction Company where whenever we get a contract to construct buildings, the principal employer has to pay the CESS to the Government as per the Building and Other Construction Act. Since the principal employer is paying CESS, is ESI applicable or not? If not, is it applicable to all the workers (principal employer, contractor, sub-contractors, etc.)? Also, please let me know how the workers can benefit from this Building and Other Construction Act.

Subject: Applicability of BOCW Act/Rules
For a thermal power plant during the construction phase, whose site plot and building plans have been approved under The Factories Act, will the BOCW Act still be applicable? Or will it come under the purview of the Factories Rules themselves?
