Let me know the letest development regarding the applicability of mathadi act, after Supreme Cour's judgement that, ' All are Unprotected except Employer.'

Hi Prakash ,
currentely the mathadi act is applicapable only to state of Maharastra for Varai and Tappi jobs . ( i.e. activities inside the truck , activities from edge of the truck to stacking , )
The Mathadi labours are to be taken from Tolis recognised by the boards .. Transport , Grocery board etc.

Dear Tushar,
You are obsulately right.
But , before Supreme Court's judgement dtd. 17/12/09 given in Century Textile & others , the the workers who are on Company's Muster Roll & Confirmed & also Contracr workers who are getting all the benefits under verious labour law are exempted from the Mathadi Act and such orders are also given by the Industrial Court because it is held that, the workers are " protected."
However, in Supreme Court's above said judgement , it is held that, " All are Unprotected Except Employer or His Family Members ". And on this ground the Labour Office making compulsion for registering the factories under Mathadi Act.
In above matter, let me know , the latest development regarding whther Employer Association has sent any praposl the Maharashtra Govt. to Delete the word ' Factory ' from the Mathadi Act Schedule.

I am a distributor of lubricant oil. We are a small establishment of total 6 people staff. I have two regular workers to load / unload material and they accompany delivery van from shop to shop in different areas. They unload material from our delivery van and deliver to shop. They cover unto 40 shops each day in a radius of 10 Kms. Is it mandatory by law to employ hamal from each local board for such unloading?

I am employee of cwc(central warehousing corporation) . Is Mathadi act applicabile for cwc??
Mathadi worker make claim on us for their payment but there payment is due on other company so how can I overcome from this situation?

All loading, unloading and stacking work is done by automatic machines. Deployed one person for operating machine(company roll).
Or If workers on company payroll, deployed for loading/unloading and stacking,
please let me know, whether it is mandatory to deploy workman under mathadi?
