Respected Inspector.
Coming to the point sir , the labours(Skilled) are to be provided to a principle Employer in a Area where ESIC is implemented.
and one of my competitor is not having ESIC Registration as he is not covered because his office is registered at non-implemented area so according to him he is Exempted for ESIC.
Now the problem between him and me is i am having additional expense of 4.75% contibution of ESIC, whereas he is not .
so my rates are highest as compared with his rate to the Principle Employer.
but my suggestion to the Principle Employer is the labours are to be provided in a premises where ESIC is implemented. whereas my competitor is not having ESIC Registration .
Eventhough I am Having all required Documents just because of highest rate due to burden of ESIC Contibution i was disquilified.
what are your suggestion in this regards. is it fair with me ? ? ? .

Only way u have to convince the principle employer by quoting the sec. 40 & 41 of the ESI Act, which says that Principle employer will be primarily held responsible for non payment of statutory ESI payment in respect of all his contract/immediate employees......
Since u are having a separate ESI Code No., u are diluting their responsibility towards statutory obligations..... Further if any of unit is depriving u on this point, u immediately contact the area inspector and inform him about the non coverage of such unit. Since after all, the coverage will extend the statutory provisions to the poor workers.
Further u can convince the employer stating that when compare the workmen compensation, compliance under ESI will be very easy which extend the provisions to their family members also............
Hope u will do ur level best..... Further I hope that the concept of implemented and non implemented areas will also scrapped soon and ur problem will be solved...

We want to get ourself register with ESIC adn EPF
Could you please give us the addresses of both the local/ reginol office address and contact numbers
One another query is
Is ESIC applicable in this particular area , if not then which act is applicable there.

i m working in a PSU and one contractor associated with our company working at " Kohdar village, Tehsil Meja, District Allahabad and depositing the ESIC on the ground that " ESI is not applicable on that site. I wish to know that whether this area exempted or applicable? Please provide if any notice/circular/list of non applicable area are if available for documentary evidence of office record.
Name of work is: Earthwork in formation , construction of bridges from km12/000 to 25/500(outside plant in connetion with construction of railway siding at Kohdar village, Tehsil Meja, District Allahabad.
