Dear Friends,
Please help me as I have query regarding ESI.
Suppose if an employee leaves the organization in the month of May 2010 (either in the middle of the month or first week of the month), is ESI applicable to him.
State the minimum no. of days / quote the rules in regard.
I request all my HR friends, to suggest in this regard.

Ur querry is not clear.....
As far as ESI is concerned even if a person work in the covered unit even for 1 second also for wages he will be covered under the ESI and u have the contribution in respect of such person....
In nut shell, all the casual, contract, daily, temporary workers..... all are covered under ESI....

ans:- acc to you employee has been worked first week of the month of may 2010 so he will be liable for the esi contribution ........ its basic rule od esic ..... wish you all the best ......

In ESI, you have contribution period (April - Sept & Oct - Mar) and benefit period (Jan - Jun & Jul - Dec). We submit returns twice in a year. May 12th for Oct to Mar period and Nov12th for Apr - Sept period. If any employee leaves in May, he may avail this facility till upto next ESI returns. (It would be Nov 12th).
It is applicable upto Sept

Dear sir,
Thanx for all of you, for your valuable suggestions.
I would like to explain the question in clear, by way of an example:-
Eg:-
x person is receiving gross salary of Rs.14,000/-p.m.
If x resigns and leaves the organization on May 11, 2010 and if he comes in the ESI bracket (due to ESI wage enhancement limit of Rs.15,000/-), my queries are:-
1. If he was relieved on May 11, 2010, is it mandatory to make emplr. ESI contribution from the orgn. side? and also as per ESI Act, is there any rules which mentions the employee should work these many no. of days in a particular month, to be eligible to cover under ESI Act, if he leaves the organization.
2. And also if x person leaves on May 01, 2010 itself, is ESI deduction applicable (both empl. & emplr) for one day also.
Your valuable suggestions are required in this matter.

I hope my earlier post answers ur question............... i.e. U have to pay the contribution in respect of two examples u have given ..... u have to pay the ESI contribution on the wages received during that period... irrespective of the no. of days/hours/minutes/seconds worked for wages....
