Hi dear thanks for the update. This has disappointed those retirees from 1.1.2006 to 31.12.2006 who are deprived of the retirement benefit at the fag end of their life. gln

Before the above amendment, the enahnced Gratuity of Rs.10 Lakhs was paid to eligble retirees from 69 central PSUs ( following central DA patern) out of 240+ central PSUs) based on the guide lines & administrative orders issued by Department of Public Enterprises w.e.f.1.1.2006 quoting the past Judgement of Hon. Supreme court.

The effective date for remaining 180 central PSUs( following industrial DA pattern) was made effective from 1.1.2007 instead of 1.1.2006 on the ground of wage revision due date & DA pattern followed.

Many of these affected retirees (1.1.2006 to 31.12.2006) have made individual appeals to concerned authorities praying for amendment in Grauity Act with retrospective date of 1.1.2006 so tht the disparity created between two groups of central PSUs and paying retirement Gratuity from two different dates one group of 69 PSUS w.e.f. 1.1.2006 & other 180 + central psus w.e.f.1.1.2007.

But the Hon. Labour Minister has not given consideration to such appeals and demand/suggestions of some of Hon Memebers when the Bill was presented in Praliament/Rajyasabha quoting the grounds of financial affordability if amendmen is made w.e.f.1.1.2006, thus the amendment is made effective from 24.5.2010. This has caused severe disappointment to this group of employees retired fom other central PSUs like ONGC, BHEL, HPCL, IOC, PGCIL, NTPC, etc. & It is very difficult to convince themselves to bear the huge loss of about Rs.6.5 Lakhs.

The Gratuity PAID ON RETIREMENT towards 25 Years+ of service was RS.3.5 Lakhs WHILE THE RETIRMENT BENEFIT LOST AS ABOut IS RS.6.5 Lakhs ( JUST FOR NOT HAVING SERVICE OF A DAY IF RETIREMENT DATE WAS ON 31.12.2006 & MAXIMUM ONE YEAR IF RETIREMENT DAE WAS ON 31.1.2006) this is really painful and severe ANGUISH/hardship in retirement life.

Financial affordability for these PSUs was not an issue since many of these PSUS are Navaratna/ Minirata /Maharatna satus companies having sufficient & huge profts) but the Managment was constrained by guidlines of DPE then.

Now one of the other options left for this group of retired / atfected individuals to get this injustice removed, is to approach the Rajaysabha petitions comittee that in the past in some cases has considered severity and given sympathtaic consideration without driving them to Judicial remedial process. This is also one of the opportunities for Central Govt. to correct themselves of the error of judgement/criteria followed.

For details & better understanding tmemeber may plese refer Parliament/ Rajyasabha portal that contains the list of names & details of 10 Honourable memebers of the comittee. It is worth to make an effort as the loss in some cases is a very huge difference of Rs.6.5 Lakhs.

Hence, I appeal to all my brethern retirees to make individual appeals through any of the Rajyasabha Memebers where ever possible if not let us joing hands and comeforward to take up the issue with respective Rajyaasabha Memebers convincing them of the injustice resulted to us and the need for sympathatic consideration to senior citizens in their retrement life.
