Need someclarifications -
Which are the laws that are applicable to employees working in the IT/ITES domain viz. BPOs/KPOs ?
Legal opinion on the following policies -
1. All Full time employees are eligible for 30 days paid leave accrued on a prorata basis. ( No heads for holidays-Privilege,CL,Sick leave etc).The employee is free to take it under whatever head.
2. The employees can encash their leave on voluntary severance only if they are confirmed and have completed 1 year tenure with the organisation.
(e.g. If an empoyees probation is extended beyond 6 months and if he was to leave in the 11th month in the organisation without being confirmed, he would loose all his leave earned )
Is the policy no.2 contravention of labour laws?
Your counsel would be highly appreciated.

are brought under two major heads as under -

(A) Acts covering "Conditions of Work"-

(B) Social Security Legislations.

its just a suggetion so take it possitive
There is so many changes required
1. ESI limits already changed 6500 to 10000 w.e.f. 01.10.2006
2. PF limit exceed 6500 to 7500
3. Minimum wages also changes
4. Payment of wages some section has been deleted
5. apprecticeship act - so many changes done today
6. ID act - few changes

Thanks for nice compilation of Labour Laws. But, it would be more colourful & authentic if latest amendments are updated in the said attachment. Certainly there are certain amendments in the ESI & EPF Act. I will be obliged if you take a note of it. Thanking you.

Very good work Sandhaya, A one missing thing in your document i.e. damages charges for defaulting payment of Provident fund of more than six month. It is 37%.

Hi abhishek
Do you know we have more than 300000 books on laws and for one Act I think for one statute there must be more than 10 authors but we need to see the presentation and efforts of the individual.
Even policies ang guidelines framed by any person/s in this worls you will find similarity in works or in same frame work. The difference is approach of an individual, we must appreciate the approach and not critised.
Sandhyas work is appreciable on one account that she has sared her works.

Its not about Appreciating and criticising people its about reading the same article with the same attachment.....

I too know there are 1 Billion Books on Laws n Laws remains the same,

But whats the use of Copy and pasting Others article in once Name

I had seen the same article in the same format and same page numbers in the same design with Common spelling mistakes with the same box size with the same font size same formatting and its 100% photo copy material of article that has been floating in Cite Hr Months Back

Every Human being should appreciate this type of Good work but As I have appreciated Some One else few months back for the same goodwork and see some one without taking a pain to even rectify the spelling mistakes and copy pasting the same hard work of some one else in His/her own name..........

It was ur nice work to complement without any hesitation.I've downloaded it for my future reference. In addition to that, I may be made clear in brief what are the legal liabilities of any organization (s) which though meets all the due statutory provisions of ESI,EPF & the Payment of Gratuity Act but, fails to comply the necessary statutory requirements? What are the penal provisions under the above Acts? I Hope you won't mind at all disturbing you time and again for getting any clarification on any topic.Thank you & hope to receive any reply from your end in respect of the above.
