Hi Seniors,
I am a newly appointed HR in a growing EPC company in Maharashtra, India.
My employers/management have been collecting original educational and experience documents from employees under contract. These documents are returned only when the contract ends or is terminated. They practice this inorder to retain employees.
QUESTION: IS IT LEGAL TO KEEP ORIGINAL DOCUMENTS OF CONTRACT EMPLOYEES?
Also IS THERE A PROBATION PERIOD FOR CONTRACT EMPLOYEES?
Seniors, please help me ASAP!!

I managed to find out about retention of original documents on Cite hr. ITS ILLEGAL!! [ PLEASE CORRECT ME IF I AM WRONG] But I did not get any strong information I could use to have this practice abolished.
I still need assistance weather there is a probation period for contract employees??

Dear Member,
Retaining the orginal documents, Experience letter is having no legality. Please refer "Indian contract act-1872" for full details.
Please do not hand over your orginals to any body at any cost.

I appreciate your response and assistance from the bottom of my heart. Yes!! I did go through that "Indian contract act-1872".
Now, Can someone please tell me if there is a probation period for employees under contract?

Dear Mahr,
I thank you for your assistance!! I was sure that there is no probationary period for employees under contract but wanted to confirm it with my seniors before I step up against it with my management.

When a person is on contract, we call him as a consultant or temporary employee or Contract employee. There is no probation period for consultants. Once their contract comes to an end, you can either extend their contract for one more year or you can terminate his contract or you can take him on your payroll a an employee.

To keep original certificate if illegality. Even after sucessful completion of education (having documentary evidance like marksheet etc) the Institute have no right to hold
The clever employee may raised FIR against company for holding his original certificate(After leaving) some organisation are keepin as employee are not aware Yes you can ask for verfication
Regarding Probation period
If the employee is causual no need
If the employee is in permanat post as the the HR policy of contracter you can confirm from day one or six month probation or one year probation but should be mentioned in Appointment letter and mutually signed
