If it is confirmed that the place of work of the diseased employee is not under ESI coverage, alternatively the company should have covered the employee under the Mediclaim Insurance as per the company policy.
Inspite of ESI coverage such employees are liable to be covered under the Group Accident Insurance.
If the above has been complied, the employee's family can claim the benefit as per the policy scheme. Otherwise there is no alternative, apart from the company's voluntary contribution [on humanitarian grounds] to the family / the funeral allowance etc.

It is totally fault at your part that you have not submitted P.F& ESI form to the respective deptt. When we enter someone on roll, we must complete all formalities related to HR. You have to submit the ESI declaration form within 10 days of joining, in which you failed, also your return for the month of February 2007 which has to sent to Provident Fund Deptt by 21st of March, in which you have to submit his declaration form no.2, which I feel also not submitted by you. I have made gross loss to the employees family, becoming a member of P.F. his family is entitle for Deposit Link Insurance and as well as Widow and Children Pension.
I must give full detail of family & deceased so that we can guide you further in this regard.
