Gratuity - Is anybody entitled for gratuity if he is worked for 4 Yrs. and 9 Months?

Hi,
You are working for 4.9 yrs in the company and as per the law who hav completed 5 yrs in one organization, are entitled for gratuity.So you can't claim for gratuity.

Dear kavimanojpandya,

Gratuity
Eligibility :
· An employee with a continuous service of minimum five years and subject to the
provisions of the Payment of Gratuity Act, 1972. The qualifying period of five
years of service will not apply in the case of the employee who dies in harness or
suffers total and permanent disablement.
Conditions :
· Gratuity is payable on retirement, resignation, death, or physical disablement.
· Gratuity may be wholly or partially withheld if the employee is discharged or
dismissed from service on disciplinary grounds.
Computation
· @ 15 days of last drawn basic salary for each completed year of continuous
service. Service of six months and above will be considered as a full year and
service of less than 6 months will be ignored.
· Period of service is calculated from the date of the employee joining the
Company or any of the Group companies.
· The Benefits under the scheme are subject to the provisions of the Payment of
Gratuity Act, 1972.

Gratuity only can be claimed after complition of 5 years of the servicein the same company.

Is this applicable for MNC employee ?
I am working in MNC in IT dept and nothing mention for Gratuity in my Offer letter or Confirmation Letter.

So if i complete 5+ years, will i applicable for Gratuity ?

As per law a person worked for more than 4years 6 months is eligible for Gratuity. I have claimed the gratuity number of times for employees have completed 4 years and Seven months

" yes" more than 5 months are calculated as one year in case of Gragyuty payment

If any employee worked 4 yrs and completes 240 days in 5th year. He is eligible for gratuity.

A Person who hav crossed minimum 4.6 and above in d same company he entitled to get gratutity
