This is in relation to a company in Tamil Nadu, if an employer has taken Employees' Compensation liability Insurance is he then required to register under Employees' state Insurance Act.

Dear Sir,
In case of a new joinee with salary (Basic+DA) in excess of Rs. 6500/- p.m. and whose PF was getting deducted in the previous organization joins an organization where they would apply for PF registration. On the date of joining n that case is the employer mandated under the law to cover the new joinee under the PF Scheme? or has a choice not to cover the employee at all being salary more than 6500?

Dear Sir,
If a new joinee draws a salary more than 6500 is there an option where he can opt not to contribute in the PF Scheme as being an excluded employee or is the employer mandated under the law to register him under the PF Act being an establishment registering for PF for the first time? could you support the same with any case laws?
