Dear ALL
I am working in a Pvt. Ltd. Co. at the time of joining they assure me that bonus will be paid on 20% of basic. It divided as 8.33% as bonus & 11.67% as EX-Gratia. This bonus is part of my CTC ( 2.25 L) as which I ask him as salary. My basic is 7250, HRA is 5750, Conveyance is 1500. Now First Year they paid us bonus as per committed. Now I resigned in the month of Feb’10 & F & F is due.
In my F & F company is only paying me 14 day salary & My Earned leave which they calculate only on Basic instead of salary which I am last salary drawing. Also they refused to give me bonus. They told me that your salary is more than Rs. 10000 & you are not eligible for bonus.
Now I wanted your help on following point.
1) Joining time salary is more than Rs. 10,000 they paid me bonus on How they can be refused me that I am not eligible for bonus.
2) Earned leave they calculate only on basic ( instead of my last salary is drawn)

Plz help me how to get my dues from company. Is there any govt rules to support me in this regards
Plz forward me.
Thanks & Regards

Dear Manoj
you are entitled for bonus as bonus will be paid to all employees whose basic is less than 10000 per month and your basic is less than 10k than why they are not paying it is not gross salary as per law.
however they can calculate leave encashment on last drawn basic.
