Dear All,
I have completed the 7 years of job in my earlier co.
Can I asked to him regarding payment of Gratuity ? Because I joined in Aug.-02 TO Sep-09. But in this period I have worked 3 & 1/2 Years in there sisterconcern co. and another 3 & 1/2 years in there Main Co. between this two co. there will be not a single gap and I am not received any appointment letter from main co.
In the above said two co. both the directors are same.
Please relay on this because it's very important for me. I know that we can claim the gratuity after 7 years but in this case can i ask for the same.

Gratuity can be claimed after completion of 5 years of continuous service in an organisation. Here in your case if you have worked on the payroll of one company for all together 7 years, you can claim for the gratuity.

Grautuity payment is applicable once you complete a service of 5 years in one organisation only.
Because in your case, you have not served complete period of 5 years in a single organisation, hence the gratuity does not stand applicable.

Organizations establish sister concerns to avoid these benefits. Legally you are not eligible. Gireesh

Dear,
You are entitled to gratuity if you had received a letter of appoitment which is an agreement accepting you into the company. Depending on the law guiding this in your area. Majorly, you don't have a letter of appointment meaning you are not qualify for gratuity. In any organisation you work for, you must receive a letter of appointment must first before anything. This letter states all that you will be paid and the benefits accruable to you.
Thank you.
