Hi Everybody,
Im a new member here on this terrific forum. I am confused about a simple issue and I need to have this clarified - In a month of 30 days, if I have 5 days Leave-Without-Pay, then will my TDS for this month be calculated on 30 days or 25 days? The accounts dept is saying it will be calculated on 30 days, 5 days deduction will be shown as LWP deduction.
My point is I have not been paid for 5 days, so my income in the month is for 25 days only. Why should I pay TDS on 5 days salary which I have not got...???
I will be very grateful if some senior could kindly clarify this pls...

As I understood your salary would be credited only for 25 days not for 30days, when there is LWP,where is the question of paying salary for 5 days & where there is question of deducting the TDS for 5 days.

This is exactly my point, but the accounts people are saying LWP is deduction from gross salary, and TDs is to be calculated on the gross salary, not the actual salary amount.
Is this correct? Pls advise me seniors, so I can resolve this issue at the earliest.

I feel your account Dpt should clarify with other A/c professionals
If the salary is calculated based on 30 days ( that includes sunday also) and the TDS will be on gross salary
in case if you were absent for 6 days where 5 days will be counted as loss of pay your gross salary would be less for t hat perticular month or if you calculate on Per annum basis also TDS will be only for the gross salary of 25 days
when there is a loss of pay automatically your basic for that mont will be reduced and also TA etc. (on that A/c should calculate the TDS )
tax will be deducted for gross salary for a prticular month not on yearly basis and where is the question of LWP ? if that is the case they have to pay your entire salary -to the Govt they are showing that they have paid your entire month salary but actually t hey haven't ....

Hey, Your ACCOUNT people seem to be crazy. If you have not earned money for 5 days how can one deduct TDS for those days salary. Amit Goyal

Dear Dhananjay,
You are correct. Your accounts people should deduct TDS only for the days they are giving you salary i.e., 25 days and not 30 days. They cannot deduct the TDS for 30 days while they are paying you only for the 25 days. TDS is calculated on the actual money earned.
