We are a manufacturing compnay having our manufacturing unit in Maharashtra. We have taken up an Annual Mainteance contract of TATA STEEL - Jamshedpur, and have employed around 25 staff, including technical staff. We have already applied for ESI Sub-code in Jharkhand as it was necessary. For PF contribution of these employees do we need to apply for SUB-CODE or we use our existing PF registration code taken in Maharashtra.
Please suggest me on this.

Hi,
Instead of having a sub-code or a fresh code for the branch, you can have a centralized code number for PF. However if u wish a separate code can be issued at branch but that will not be a sub-code. In my opinion separate code is not required if u can do compliance from Maharashtra.
However in esic sub code is required for the benefit of the employees.

In my opinion, you can continue to cover the employees working at Jharkhand in your esising code for Provident Fund. There is no need to have separate PF code.
You may comply in the existing code and send copies of relevant records to your camp office at Jharkhand.
Importantly, keep the Principal Employer (TATA in your case) formally apprised through letter about your compliance for employees deputed at their site.

Request for one more clarification on the subject -
We have not taken the workers on our payroll, but are on contractor's payroll. We are only paying their PF & ESIC dues every month through our code. Is there any problem in following this system ?
Further, if we are paying their PF & ESIC through our code, will they be on our payroll. I am asking this question because, if we discontinue with the contract, we cannot get these workers to Maharashtra, which is also not convient for the workers.
Please revert.

Dear if you r paying their pf and esi through your code its means you have also filled their nomination form (Form2-pf) through your code so directly they will be considered on your roll. payush
In earlier days PF department used to allot Sub Code to principal employer for submitting contributions of contractor's employees.
Now a days PF dept insists on contractors having their separate code.
It is advisable to ask contractor to obtain code and comply for its employees through that code.
Regarding ESIC my exposure is limited. But similar practice may be prevailing.

Our sub-contractor already has a PF & ESI code, and all these years he has been paying the dues of PF & ESI through his code. Now the principal employer is insisting on paying the dues through our code. In this case, all the workers will be on the payroll of the sub-contractor and the ESI & PF dues will be paid by us through our code.
