some questions I got left here (in regard to work in an Indian agency):

Max. working hours per week (apart from factory act) is 48 hours a week..

Question 1) Does this mean that it is allowed for one to work lets say 7 days/week with 6 1/2 hours each day?

Or is it strictly allowed to only work a max of 5 days/week?

Question 2) If so, does this apply to the company itself or just the individual employee? Meaning, can the company operate 7 days a week if it takes care that each individual worker does not exceed the limit?

Question 3) If less than 7 days per week are allowed only, can the company choose on which days it wants to open (for example sundays)?

Question 4) Are there certain days on which the compensation must be higher?

Question 5)
Does it matter when in the day, one works? Just to make it clear what I mean, is working from 10pm-5am allowed?
Is the compensation higher during certain hours?

Final Question) If the above is true, is it allowed for the company to 24 hours if it assures that no individual employee works longer than allowed (For example by using shifts)?

Dear Jasc,

Any where every where it is a must that one day in a week should be an off. In some companies they work for more hours and obtain 2 days weekly off.

The maximum no.of hours only mentioned hence if they work less hours also a day in a week should be an off for each employee.

If an individual employee then it is his own area and how many hours and days he will work and the benefits also he will only enjoying and there is no such rule.

In continous process industry the company will work for 7 / 365 days hence there the staggered weekly offs are applicable ie., some people will avail weekly off on Monday / some on Tuesday / wed etc.,

On National / festival holidays / extra hours worked then the employees are eligible for wages @ double

In some organizations like IT / BPO etc companies most of the people are deployed in the might only and in continous process industry employees work in the nights on rotation basis. The employees who are working in the nights are being provided with additional facilities like pick-up dropping, night shift allowance, snacks / tea - free of cost etc.,

The following points may clear your doubts
1) Total working hours = 48 hours /week
(a) 8 hours /day in 6 working days or 9 hrs 30 min x 5 days
(b) 1 day paid weekly off.
(c) There should be a break in after 4 working hours.
2) Company may work 24 hours a day and 7 days a week, in shift / rotation, depending upon the locality / approval from the local authority, if required.
3) Weekly off may be any day but should be convenient to majority of the employees.
4) If worked on weekly off / holidays employees are to be paid double the wages. Also, in case of over time (OT) beyond 48 hrs/week. payment for OT hours should be double for certain employees.
5) 10PM to 5 AM is allowed only in case of more than one shift with approval from local authority.
6) Shift duties are allowed.
In addition, there are certain rules that allows employees for holidays, leaves etc.
