Dear All,
I am working for a software company in Hyderabad. We have our head quarters in USA. We wanted to sponsor for couple of H1 B visas thorugh our US company and once H1 is approved, visa stamping is done would depute them to US to work on the client assignments. Till the H1 is approved he will continue working with his current company. Given the visa processing expenses, travel expenses there is a risk involved if the candidate is not willing to travel to US after the visa processing or may not report in US. I wanted to know that what is the practice followed in the companies to ensure that they join the company? Do they take any deposit or any kind of service agreement.
Request you to provide the required information, it would be of a great help to us.

Hi Geetanjali,
Agreement is a necessary one for the Employees who has assigned Job at their parent company or their client.
For this you have to discuss with your companys advocate and get a good suggestion.
We have also sent few of our employees to abroad for training purpose. We have prepared an agreement in order to ensure their stay in the company for couple of years. Our advocate has drafted the Agreement. So you can also check with your companys advocate & get his suggestion.

Hi Geentanjali:
Usually a security deposit is taken from the candidates, so that even in case if the H1 stamped guy does not join your company, you will get back the processing fee. The security deposit value varies from company to company.
So you could talk to your management and decide.

This is tottaly depends on company rules and regulation. This are the
things are decided by managment of the company. So PLease put words
in front of them definatly they will do something for this kind of suitaion.
But some of company follows agrement. Even u can follow the same if u
do.
