Hi, I have resigned from a organization in probation period without giving notice period. I wrote thrice about my resignation and requested them for acceptance. I was ready to pay in lieu of the notice period.
My question is whether it is mandate to serve the notice period when you are willing to pay in lieu of the notice period.
The company is not providing me the acceptance and relieving letter and forcing me to serve the notice period. Please advice whether any legal action can be taken as per labour laws?

Dear Gaurav
Please refer your appointment letter issued to you while joining the organisation. Go personally to your HR Department and politely enquire about the buy back of your notice period and give them assurance that you will do all the knowledge sharing and proper handing over to your successioner.
Then ask about your relieving letter and your clearance form and make further move ahead.

Hi,
One of my friend has recently resigned from his company but as he could not complete his notice period, the company will not give him any release letter. Also his new company do not want any release letter from him. But I have suggested him to take the release letter from his current organisation for his future career.
Pls give us some letter format where he can write a letter to his HR requesting for the release as he is ready to pay also for the notice period.
