Dear All,
I have one question in relation to maternity benefit act
As per maternity benefit act leave is allowed for 12 weeks.
6 weeks before delivary and 6 weeks after delevary.
But if a women extended her leave for more than this period then what is the provision under the act is she eligible for the payment for those days?
and how much days she can extend her leave?

Dear Kranti,
as per the act only 12 weeks are allotted to female employees, if the women employee
has taken more than that she would not get the payment for that days and she will get the payment from the ESIC if she will covered under ESIC. And it depends also on the company policies also

Dear Kranti, there is no extended period if the baby was expired in delivery at that time the leave will be extended up to more 3 weeks

we all know that there is a rule that the maternity leave shall be availed before 42 days and after 42 days to the delivery date. However, if any Pregnant women extends her maximum working period in the company to her actual delivery date. in that case, can she avail 84 days benefit at a one stretch after her delivery.
please reply in urgent. we have such case to handle.
