Dear Ujwala,
In my opinion you are right in calculating the amount of leaves & can be stated to be in accordance with the provisions of the Maternity Benefit Act, 1961.

Dear All
I am K.C.Seshadri request you all to clarify me on the following points with respect payment of maternity benefits :
1) Recently one of my colleague has delivered prematurely a month earlier. She has actually applied for maternity leave as per the date the Doctor has indicated for delivery.
When she claims her maternity leave HR department initially said that the maternity leave is applicable only to those whose services are confirmed.
Then they said to her that after she resumes her duty and after 2 months only she will be considered for maternity benefits. The reason for this is that the management has framed a new policy of their own not legally approved one.
So they will consider paying her maternity leave benefits after 2 months from the date of her resuming duty?
Is it legally correct?
Please clarify me with legal inputs so as to enable her to take up the issue with HR one again.
I shall be thankful to you all if you guide me in this.
Thanks and I remain
