Am i entitled to adjust my accumulated leave balance against my shortfall in notice period if my employer releases me before my quoted last working day?
Hi i have recently resigned from a mnc. as per my contract the notice period is 3 months. i applied resignation on 1st july and asked written 16th july as my preferred last working day. however the company decided to relieve me on 14th july itself. but they are adjusting 78 days of my accumulated leave balance against it. my question is if my employer is releasing me before my preferred last working day am i entitled to adjust my accumulated leave balance for the shortfall in notice period?
Adjustment of notice period against accumulated earned leaves
Hi in my present company as per the hr policy they have mentioned that : notice period waiver is first adjusted against the accumulated leave balance if any of the colleague. the remaining accumulated leaves will be encashed as part of f & f settlement. however if the accumulated leave balance is insufficient for adjustment against notice period waiver the colleague will compensate the company as stated in c above. currently my notice period is 90 days and i have around 20 earned leaves in my account. when i talked to my manager regarding my last working days and regarding adjustment of earned leaves against the notice period he denied saying that the leaves will not be adjusted against the notice period and this is the instructions from the higher managment. now when there is a policy that notice period waiver will be first adjusted against the accumulated leave balance how they can do this ? is higher management above the company hr policy. please tell me is there any way i can legally fight with them on this ? regards manoj
Can the sick leave be accumulated please
Dear anks thank you for your information on sick leave for various states. would like to know whether sick leave will lapse after 2 years. i.e if someone had not availed sick leave for 2 years he would have accumulated 24 days sickleave. in the third year will he have sick leave balance as 24 or 1 please. request your reply please. thanks & regards b 9094007603 bvijayakrishnanrediffmail.com
Legality of accumulated el/pl and leave balance lapsing?
Dear sirs i am working in a private ltd company as a h.r.in my company some permanent staff members have their leaves balance as el or pl.at every year end they have their leave balance and previous hr was carry forwarded their leaves in every next year.now the query is they have more than 100 leaves balance on their cards.now what can i do. as per law it is ok or the leaves may lapse after some certain period.plz advice. kiran.
Lapsing of earned leaves
Recently my companygurgaon based telecom company has changed the policy for earned leaves. here is the extract from the policy. to achieve a greater worklife balance employees will now be encouraged to take annual leave to rejuvenate themselves and enhance their quality of life. an employee will continue to be entitled to 25 days of earned leaves in a calendar year which are credited in two equal installments of 12.5 days each in the month of january and july. henceforth earned leaves if unavailed can be accumulated upto a maximum of 30 days. once the maximum limit of 30 days is accumulated 50 of unavailed leave balance as on 31st dec will be encashed and paid alongwith january payroll in the following year and the balance 50 of unavailed leaves will lapse. my question is:is it legal to lapse employees earned leaves?is there any act which supports that? can we challenge it?
{factories act} earned leave : during service encashment/lapsation of balances
Dear all need your expert advice. our company falls under factories act is redrafting its earned leave policy. the company has decided to keep the annual entitlement to 20 days and the maximum carry forward allowed is 30 days. assuming an employee does not avail any leave balance the accumulation pattern would work out as follows 1/1/2018 : date of joining 1/1/2019 : 20 days credit for the previous year worked 1/1/20 : 20 days credit for the previous year worked total balance now 40 days 31/12/20 : 40 days accumulated balance. 1/1/21 : 30 days revised balance excess 10 days get lapsed or encashed my question is is there any law/section/subsection which mandates the company to compulsorily encash the excess 10 days on 1/1/21 ? alternatively from a compliance perspective would it cause any issues if the excess 10 days were to be lapsed? thanks in advance for your time and inputs. take care & be safe.
