Under the Factories Act, during a calendar year, Jan to December, to be entitled for EL, an employee has to have worked for a continuous period of 240 days. This includes Weekly Offs, Leave including LWP. Only period of unauthorized absence from work will not be included in these 240 days which is the basic qualifying criteris for entitlement for EL.
EL is claculated at 1 day for every 20 days worked.
For purposes of 240 days EL is also taken into consideration. HoweverEL is not earned for days when one has been on EL or any other form of leave.
EL earned during the current year can be availed only in the following year.
Encashment of EL is generally done on Gross pay.
