Hello, i am working in a company since july 2001. Before 2005 my company was under proprietorship and in 2005 it was converted into private limited w/o giving full n final to the existing employees. Earlier it use to give 12 leaves in an year but after it became pvt ltd, they started giving 15 But we were never given any encashment of

Its depend on the company policy, company can encash 50% everyear or can carryforward & encash at the time of resignation/retirement. Rgds/Jitender

Dear Frn,
Its totally depends on co's policy tat wat they want to for settlement of leave encashments.
However, as per labour laws....leave encashment should payable at retirement or sepration from the job

if leave echasement provision is in the standing order of the company then u may complain it to the zonal labour inspector /commissioner with the salary received proof not having the amount of your leave encashement.

Leave in many companies the procedure is, the employee is allowed to accumulate his leave up to 30 days, if his services are of urgent and of essence the employer allow such employees to accumulate his leave even more of days.
Leave in some companies as per their existing policy, disburse the leave with wage for the accumulated leave in the month of January.
Actually leave is encashed only on resignation, retirement or on death of an employee, if a n employee who do not use his leave can accumulate upto 30 days as under factories Act, and after reaching 30 days of accumulation he or she has to utilise their leave or else it will get lapsed.
It is the employer discretion whether or not to encash leave during the employee is in service.

Hi,
As per shop and establishment act.every employee is eligible for earned leave .Theunutilsed leave at the time of parting of service should be encashed and cash paid to parting employee.
