A company has changed its name & location, I needed to update the same with shops & establishment, chennai , Wanted to know how to go about it and where shoud we submit application

Dear AS:
A review of the TN Shops & Establishments Act, 1947 reveals that there is no requirement for registration of an establishment with any statutory authority like the Companies Act, 1956, Factories Act and several other Acts. It is an Act requiring adherence to specified provisions by all establishments in the specified area. There are number of obligations imposed by the Act like Employment of Children, Measures on Health & Safety, Holidays with wages etc. Maintenance of prescribed Registers etc. . These will have to be followed. The Act therefore does not require anyone to notify to any prescribed authority of any change in the name or location or address of an establishment under the provisions of this Act.

To my best knowlege there is no requirement for registering a shop under any authority however we must submit form 1-5 with labour inspector which stands as register. which talks about National and Festival Holidays.

Hi Roshan mostly the Hotels and restaurants will be covered under the tamilnadu catering establishment act,1958.this also covers most of the acts as mentioned in Shops and establishement act. regards

Dear Vini,

I have read your question raised by you. In this I wish to inform you that in Turupur you have to register with the local Asst. Inspector of labour for shop and establishments Act if your company is an establishment by submitting the following forms and registers duly filled and signed.

Form I, II, III (Blank) and V under National and Festival Holidays Act, in duplicate together with Rs.2/- court fee stamp affixed on Form No.I.

Form S - Weekly Holiday under Shops and Establishment Act in duplicate and whenever new employees joined you have to send it again stating the present employees details as per Form S.

As far as Registers concerned you have to fill these registers.

Form P, Form Q, Form R and Form T under shops and Establishments Act,
Form A - Myster Roll under Maternity Benefit Act, Form VI under National and Festival Holidays Act, etc.

If it is a factory you have to get license from the Factory Inspectorate and that can be renewed each and every year. Please go and contact your area Factory Inspectorate for detailed information about the license fee and the registers to be maintained.
