No, it is not yet amended. As per newspaper reports govt. is planning to introduce bill in Budget session of Parliament in this regard.

When the amount of gratuity payable to an employee shall not exceed Rs.3.5 lacs then nothing is going to happen to the balance amount.Gratuity amount is to be calculated as per section 4 of this Act.
