I am not sure of the clause you have in your offer letter. If you are in a probation period or training period then you are not entitled for maternity leave.
Generally the probation period is set for 6 months. But this varies from company to company. As per the governmental rule min 80 days of work. Maternity leave is generally for 12 weeks.
So please check up with your HR team. Some company also pay only the basic part of the salary, so please validate with your team

Dear all,
I find confusion in the minds of HR fraternity on this issue.
As far as leaves of any kind are concerned, there are Govt. Laws which can not be violated. We can give more benefit than what is legally applicable but if we give less, it is a violation of law.
For example law nowhere talks about probation period in case of leaves. If a technician has joined an organisation where Factories Act is applicable on 1st December and has put in 20 days of actual work, on coming 1st January, we will have to show one E/PL to his credit irrespective of the fact whether he is on probation or not. Therefore any Company policy which says 'no leaves during probation period' is violative of law.
Coming to Maternity Leave: if law says only 80 days of work is essential for grant of Maternity Leaves, then if employee has put in 80 days of work, she will have to be allowed Maternity Leave.

Yaa this can vary but the thing is any female employee can eligible for maternity benefit as per the Maternity benefit act 1961. if ur company is following that then u can claim. Regards, lalita
