If a cotractor employs less then 20 workers in an establishment, does he still required to 1.maintain statutary registers
2.file half yearly returns
3.give notices for commencement/comletion of work in form VI A

Dear Gautam,
If the applicability of the Contract Labour (R&A) Act, 1970 is not there then you are need not to maintain registers under this particular Act. Other compliance are also not to be made. In that case you are to maintain the registers & records under the Acts under which the contractor establishment is covered.

The Contract Labour (Regulation and Abolition Act, 1970) applies to :
a) to every establishment in which twenty or more workmen are employed or where employed on any day of the preceding twelve months as contract labour;
b) to every contractor who employs or who employed on any day of the preceding twelve months twenty or more workmen.
Hence as per the said act when the contractor employed less than 20 workmen in a given period of 12 months, then there is no need to maintain any statutory registers as prescribed under this act.

Hello Gautam, As per Act any establishment where there is 20 or more workers at any point of time during a calender year the Act shall apply.

I am from Engineering co. for fabrication of materials & we need suggestion for we will try to do installation work with other firm without any nomination of my organization with using our manpower they are also covered under ESI & what will documents need to We will do work from other firm.& can it is possible to we do work from our organization with other firm nomination. if yes,Kindly give me details of How? If not please explain me why & give docmunents of that.
