Dear friends,

Yesterday Parliament has passed Workmen's Compensation (Amendment) Bill 2009 which mainly provides for the following:

a) Change of name of the Act to Employees Compensation Act 1923

b) Enhancement in minimum compensation payable from Rs.80,000 to Rs.1,20,000 (in case of death) and from Rs.90,000 to Rs.1,40,000 (in case of permanent disability) and funeral expenses from Rs.2,500 to Rs.5,000.

c) Reimbursement of actual medical expenses incurred during treatment of injury caused during course of employment.

d) Increase in coverage by omission of restrictive clause in Schedule-II and inclusion of additional hazardous activities

e) Disposal of cases of compensation by Commissioner within 3 months

f) Empower Central Govt. to specify monthly wages for the purpose of compensation and enhance minimum rates of compensation from time to time.

Copy of the Bill is attached for your ready reference. It will become Act after getting the assent of the President and will come into force on such date as may be specified in the notification to be issued by the Govt.

Workmen's Compensation (Amendment) Act 2009 has come into force on 18.1.2010. Pl. see notification below:
Section 1 of the Workmen’s Compensation Act, 1923 - Commencement of Act - Notified date for enforcement of Workmen’s Compensation (Amendment) Act, 2009
Notification No. S.O. 101(E), dated 18-1-2010
In exercise of the powers conferred by sub-section (2) of section 1 of the Workmen’s Compensation (Amendment) Act, 2009 (45 of 2009), the Central Government hereby appoints the 18th day of January, 2010, as the date on which the said Act shall come into force.

Dear Friends, It is no more a bill. It has converted in to Employees compensation Act and has been made effective from 18.01.2010.vide notification no. S.O.101(E) dt. 18 Jan.2010. regds anil kaushik

Dear All,
The copy of the Gazette Notification of WC Amendment Act-2009 & Notification for WC Wage Limit Amendment is attached herewith for your record and ready reference.
In my view these amendment will effect all the WC cases pending for decisions irrespective of the Date of Accident or Date of filing of WC Claim.
Seniors please correct if this is incorrect.
